Public Offer Agreement for the Provision of Flower Delivery Services

This document is an official public proposal (offer) of Sole Proprietor Yovenko Oleksandr Vasylovych, hereinafter referred to as the “Seller,” to enter into an agreement on the terms set out below.

The offer is public in accordance with Articles 633 and 641 of the Civil Code of Ukraine, as well as in accordance with the Law of Ukraine “On Electronic Commerce.”

Each Client (Buyer) who accepts the terms of this Agreement automatically agrees to all of its provisions.

  1. Subject of the agreement
    1.1. The Seller undertakes to provide the Client with services for the creation and delivery of floral arrangements, bouquets, and related products, and the Client undertakes to pay for and accept these services.

1.2. The description of the goods, delivery terms, and prices are posted on the website https://www.martaflowers.kiev.ua/, which is an integral part of this Agreement.

  1. Acceptance of the offer and conclusion of the agreement
    2.1. Acceptance (agreement to the terms) of this offer is the confirmation of the order by the Buyer on the website or through other communication channels (telephone, messengers, email).

2.2. From the moment of acceptance, this Agreement shall be considered concluded.

  1. Rights and obligations of the parties
    3.1. The Seller undertakes to:
    Fulfill the order in accordance with the terms specified on the website.

Deliver the goods within the agreed time.

Inform the Buyer of possible changes (unavailability of flowers, rescheduling of time, etc.).

3.2. The Buyer undertakes to:
Provide accurate information for order fulfillment (name, address, recipient’s phone number, etc.).

Timely pay the cost of the goods and delivery.

  1. Payment terms
    4.1. Payment is made cashlessly through the payment services available on the website.

4.2. The order is considered accepted for fulfillment only after full payment has been made.

  1. Delivery and transfer of goods
    5.1. Delivery is carried out to the address specified by the Buyer, within Kyiv and other settlements of Ukraine in accordance with the terms on the website.

5.2. In the event of the recipient’s absence at the specified time, delivery may be rescheduled upon agreement with the Buyer.

  1. Quality guarantees
    6.1. All flowers are delivered fresh, in compliance with storage and transportation standards.

6.2. If the arrangement significantly differs from the selected sample, the Buyer has the right to submit a claim within 24 hours.

  1. Liability of the parties
    7.1. The Seller shall not be liable for the impossibility of delivery due to reasons beyond his control (incorrect address, absence of the recipient, restricted access to the facility).

7.2. In the event of unforeseen circumstances (force majeure), the fulfillment of obligations may be postponed.

  1. Refunds
    8.1. Refunds are possible in the following cases:

erroneous double payment;

cancellation of the order at least 24 hours before the delivery time.

8.2. Refunds are made within 5 business days using the same method by which the payment was made.

  1. Personal data
    9.1. The Client gives consent to the processing of personal data in accordance with the Law of Ukraine “On Personal Data Protection” for the purpose of fulfilling the order.

9.2. Detailed information is contained in the Privacy Policy.

  1. Final provisions
    10.1. The Seller has the right to change the terms of this Agreement without prior approval from the Buyer by posting the updated text on the website.

10.2. All disputes shall be resolved through negotiations, and if it is impossible to reach an agreement, in court in accordance with the current legislation of Ukraine.test

IN WHICH CASES CAN I REFUSE TO ACCEPT FLOWERS?
If the bouquet contains flowers that are not fresh, or if it is not the bouquet you ordered, the couriers are instructed on how to handle this — they will contact the managers themselves, and a manager will call you to resolve the issue.
IN WHICH CASES CAN THE BOUQUET BE REPLACED?
If the flowers are in poor condition, take a photo and send it to us. We will either replace the bouquet or issue a refund.
IS PREPAYMENT REQUIRED?
We require prepayment when placing wedding orders, including the bridal bouquet, in the amount of 50% of the bouquet’s cost. We also require prepayment for unique custom orders starting from UAH 5,000. Regular orders are accepted without advances or prepayments.
CAN I CANCEL A PAID ORDER?
In case of force majeure, we are willing to be flexible, but please understand that order cancellation is only possible at least 24 hours before delivery. On the day of delivery, after the bouquet has already been made for you and dispatched, it is no longer possible to cancel the order.
WILL THE ORDER BE DELIVERED IF A PAYMENT ISSUE OCCURS?
There are cases when the entire banking system is not working or when it is impossible to process an international transfer on a weekend. We are willing to be flexible — the delivery will be made on time, and we will accept the payment later based on trust.
WHAT ARE THE WORKING HOURS OF YOUR DELIVERY SERVICE?
Delivery across Kyiv is carried out from 06:00 to 21:00, seven days a week. Orders are accepted from 09:00 to 20:00, seven days a week.
HOW MUCH DOES DELIVERY COST AND WHAT AFFECTS THE PRICE?
For standard delivery (a 3-hour time window) across Kyiv, the cost is UAH 200. Outside the city, the cost is UAH 300. More remote населенные пункты of the Kyiv region are calculated separately. Delivery at an exact time is an additional UAH 100.
WITHIN WHAT TIME CAN I EXPECT A REFUND?
Within 3 business days from the moment the complaint is approved.
